NBN speed slowed with 3 weeks to go due to Telstra's mistake

Hi

 

Throughout the past week I have been attempting to download and back up all my iTunes purchases and other files. These are all HD so they are of a fair file size. During this whole time (Saturday-Wednesday) the speed was a lot slower than usual and the connection would keep going up and down, meaning that the downloads/uploads would fail and start again, over and over. I found out that the culprit was this:

Telstra updated my box's filmware and started an ongoing loop of terror, and because of it all my data is gone and wasted. For the remainder of this period (22 days), I am stuck with extremely slow internet when I need it for work and my daughter needs it for her university studies. Am I entitled to having my usage reset? I should also mention that last year Telstra had my speed slowed incorrectly for a full month where I used no data and they didn't give me any refund, so I feel that I definetly am owed this.
